Uso e abuso del termine devianza
Use and abuse of the term “deviance”

di Bruno Maria Bilotta

Abstract: The focal point of all analyses of deviance centers on the preposition “da” and the ellipsis that follows it. The entire fifty-year history of the concept and the term “deviance” itself revolves around this focal point—a concept that has been so widely used and abused that it has led to its decline and replacement with other, more specific and meaningful terms. It should not be forgotten that throughout the 1970s in Italy—at the height of the term’s popularity—the “label” of deviant was applied to the most diverse and divergent categories, ranging from the most hardened criminal to the slightly mischievous teenager, thereby contributing to the ambiguity that already surrounded the term. This essay, which is descriptive, reconstructive, and above all critical in nature, aims to shed light on the diverse and often conflicting interpretations of the term and concept that have been offered over the years.

L’istituto della fiducia nel rapporto tra diritto, metodologia ermeneutica e democrazia
The concept of trust in the relationship between law, hermeneutic methodology, and democracy

di Matteo Bellani

Abstract: Mutual confidence (trust) between individuals and institutions has always been a fundamental human pillar for the creation and maintenance of the legal system. The relationship between trust and law is a topic widely discussed by renowned authors, both internationally and in Italy. In this area, Professor T. Greco has provided important juridical and sociological contributions and reflections, enriched by concrete examples from our everyday lives. It is also interesting to observe the Swedish political, legal, and social landscape, where citizens and judges place firm trust in the authentic will of the legislator, namely, Parliament, the supreme representative of popular sovereignty and guarantor of the democratic values of one of the most stable welfare states in Europe. Returning to the national context, Article 94 of the Italian Constitution institutionalizes the relationship of trust between the legislative and executive branches. In this context, we can find the moments and canons of contemporary hermeneutic methodology, as defined by Professor Francesco Petrillo, whereas the vote of confidence in the executive cannot be reduced to a mere expression of political will, but is based on a complex legal interpretative process, in which Parliament is called upon to balance the country’s public interests with respect for constitutional principles, the protection of minority rights, and consideration of contingent political, economic, and social circumstances. Finally, to strengthen contemporary society’s trust in democracy and its institutions, it is essential to promote the transmission of democratic values, not only politically but also juridically, through the educational and training system, particularly through schools, in order to foster the full development of the human person.

The cancellation of a people through property destruction, forced migration and ethnic cleansing. The case of Myanmar’s Rohingya under Tatmadaw persecution

di Alessandro Corti

Abstract: This article examines the persecution of the Rohingya in Myanmar as a process shaped by forced migration, ethnic cleansing, and organised state violence. Focusing on the 2017 attacks in northern Rakhine, it argues that the mass atrocities committed against Rohingya civilians were not merely a disproportionate response to insurgent activity, but part of a broader pattern of systematic oppression. Drawing on international reports, witness testimonies, and satellite imagery, the article analyses the destruction of Rohingya villages, the large-scale displacement of civilians, and the operational role of military units implicated in the violence. It further considers whether the scale, coordination, and methods of the attacks point to planning at the highest levels of command. The article contends that the violence in northern Rakhine must be understood not only as a humanitarian catastrophe, but also as a politically structured project of removal and erasure.

The genesis of evil and ponerology: pathologies, institutions, and the veiling of harm

di Davide Costa

Abstract: This paper explores the interdisciplinary science of ponerology, developed by Andrzej Łobaczewski, as a framework for analyzing the origins, mechanisms, and diffusion of evil. Moving beyond traditional moralistic or theological treatments, ponerology employs psychological, sociological, and medical analogies to conceptualize evil as a natural and social pathology. It introduces key concepts such as ponerogenesis (the genesis of evil), hysterization (the collective spread of irrationality), and pathocracy (the rule of pathological elites). These processes demonstrate how individual disorders and pathological traits can infiltrate institutions, distort ideologies, and ultimately shape macrosocial systems of domination. The paper situates Łobaczewski’s theory alongside contributions from Hannah Arendt, Zygmunt Bauman, Jeffrey C. Alexander, and Davide Costa, highlighting the complementarity of pathological, structural, and cultural approaches. Emphasis is given to the notion of “veiled evil,” which underscores the hidden and normalized ways in which harm permeates everyday practices, ideologies, and institutions. While ponerology offers an innovative vocabulary and causal framework, its limitations include a tendency to overemphasize psychopathy and a lack of empirical validation. The study concludes that integrating ponerology with broader interdisciplinary perspectives is essential for a comprehensive understanding of systemic destructiveness. Ultimately, this work underscores the importance of unveiling the subtle mechanisms of evil in order to foster resilience, social immunology, and preventive strategies against destructive forces

Conseguenze visibili e invisibili della salute nella mobilità di genere
Visible and invisible consequences of health in gender mobility

di Lucia Landolfi

Abstract: This paper aims to analyze the relationship between social mobility, gender, and health, examining how mobility pathways affect women’s well-being, also in light of the regulatory frameworks governing fundamental rights and equal opportunities. To this end, a scoping review was conducted following the PRISMA-ScR protocol (Tricco et al., 2018), using the Scopus and PubMed databases. The findings highlight that the effects of mobility are deeply differentiated by gender and further stratified by other dimensions of inequality. In particular, women’s social mobility emerges as an ambivalent and non-linear process, characterized by the coexistence of opportunities and social implications. Overall, women’s social mobility appears as a complex and structurally conditioned phenomenon, with significant implications for well-being and health, both in their visible and invisible dimensions, prompting further reflection on the role of law in ensuring effective conditions of equity.
